I. SUBJECT
Art. 1. These general conditions are intended to regulate the relations between "TECHMART" LTD, 62 Spyrou Kyprianou street, 4154 Kato Polemidia, Limassol, Cyprus, hereinafter referred to as "TECHMART " for short, and the customers, hereinafter referred to as USERS, of the electronic store "www.techmart.com.cy", hereinafter referred to as the "ELECTRONIC STORE".
II. DATA ABOUT "TECHMART" LTD
Art. 2. Information according to the Law on Electronic Commerce and the Law on Consumer Protection:

III. CHARACTERISTICS OF AN ELECTRONIC STORE
Art. 3. ELECTRONIC STORE is an electronic store available at the Internet address www.techmart.com.cy, through which Users have the opportunity to conclude contracts for the purchase and sale and delivery of the goods offered by the ELECTRONIC STORE, including the following:
1. To register and create of an account for browsing the ELECTRONIC STORE and using the additional services for providing information;
2. To make electronic statements in connection with the conclusion or execution of contracts with "TECHMART" LTD through the interface of the ELECTRONIC STORE page, available on the Internet;
3. To conclude contracts for the purchase and sale and delivery of the goods offered by "TECHMART" LTD through the ELECTRONIC STORE;
4. To make any payments in connection with the concluded contracts with "TECHMART" LTD through the ELECTRONIC STORE, according to the payment methods supported by the ELECTRONIC STORE;
5. To receive information about new goods, promotional offers, campaigns, offered "TECHMART" LTD through the ELECTRONIC STORE;
6. To have the opportunity to subscribe to receive by e-mail the newsletter of the ELECTRONIC STORE, after expressing consent to this;
7. To review the goods, their characteristics, prices and terms of delivery;
8. To be notified of the rights arising from the law primarily through the interface of the ELECTRONIC STORE page on the Internet;
Art. 4. (1) "TECHMART" LTD supplies the goods and guarantees the rights of the Users, provided for by law, within the framework of good faith, accepted in practice, consumer or commercial law criteria and conditions.
(2) Any use of the ELECTRONIC STORE means that the Users have carefully familiarized themselves with the general conditions for its use and have agreed to abide by them unconditionally.
(3) It is possible, due to the limited space and structure of the information, that there may be incomplete or inaccurate product descriptions. However, "TECHMART" LTD strives to provide the most relevant and relevant information.
(4) All goods, including those in a promotion/discount, are sold and delivered while stocks last, during the period of the promotion/discount, even if this is not explicitly stated in the ELECTRONIC STORE.
(5) ELECTRONIC STORE may contain links to other sites. "TECHMART" LTD is not responsible for the privacy policy of websites that it does not administer, as well as for other information contained therein.
Art. 5. (1) Users conclude a contract for the purchase and sale of the goods offered by "TECHMART" LTD through an ELECTRONIC STORE, available on its website at www.techmart.com.cy.
(2) By virtue of the contract concluded with the Users for the purchase and sale of goods "TECHMART" LTD undertakes to deliver and transfer the ownership of the User to the goods specified by him through the interface.
(3) Users shall pay to "TECHMART" LTD the price announced at the address of the ELECTRONIC STORE on the Internet for the delivered goods, as well as the price for delivery in accordance with the conditions set on the website of the ELECTRONIC STORE and in these general terms and conditions.
(4) "TECHMART" LTD delivers the goods requested by the Users within the terms and under the conditions set by "TECHMART" LTD on the ELECTRONIC STORE page and according to these general terms and conditions.
(5) The goods offered in the ELECTRONIC STORE are intended for home use and are sold in quantities usual for a household. In case of doubt that a User (individual or legal entity) intends to purchase goods in quantities and/or for the purpose of resale and/or for the purpose of non-intended use, "TECHMART" LTD reserves the right, at its discretion, to refuse the sale of the ordered goods to such persons.
(5) The price for the delivery is determined separately and explicitly from the price of the goods.
Art. 6. (1) The user and "TECHMART" LTD agree that all statements between them in connection with the conclusion and execution of the sales contract can be made as electronic statements within the meaning of the Electronic Document and Electronic Signature Act . In accordance with the Electronic Commerce Act, the statement of conclusion of the contract and the confirmation of its receipt are deemed to have been received when their addressees have access to them.
(2) It is assumed that the electronic statements made by the Users of the site were made by the persons indicated in the data provided by the User during registration, if the User has entered the corresponding name and password for access.
IV. USE OF ELECTRONIC STORE
Art. 7. (1) In order to use the ELECTRONIC STORE to conclude contracts for the purchase and sale of goods, the User must:
1. Register on the ELECTRONIC STORE site, filling in all the identification data required at the time of registration as a user on the site;
2. To enter his chosen name and password for remote access, in cases where the ELECTRONIC STORE requires this.
3. The user can use the services of ELECTRONIC STORE also as a non-registered user by entering the required data for sending an order.
(2) The name and password when registering for remote access are determined by the User, through electronic registration on the website of "TECHMART" LTD.
(3) By filling in his data and pressing the "Yes, I accept" and "Registration" buttons, as well as by generating an order as an unregistered user, the User declares that he is familiar with these general conditions, agrees with their content and obliges unconditionally to comply with them.
(4) "TECHMART" LTD confirms the registration made by the User by sending a message to the email address specified by the User, to which information on activation of the registration is also sent. The recipient confirms the registration and the conclusion of the contract through an electronic reference in the letter with which he is notified of the completed registration, sent by "TECHMART" LTD. After the confirmation, the User's account is created and a contractual relationship is established between the User and "TECHMART" LTD.
(5) When registering, the User undertakes to provide correct and up-to-date data. The user has the obligation to promptly update the data specified in his registration in case of change. "TECHMART" LTD bears no responsibility in the event of damages occurring as a result of outdated data.
Art. 8. (1) Users of the ELECTRONIC STORE must provide their e-mail address ("Primary contact e-mail address") during their registration and when generating an order for the purposes of communication and exchange of electronic statements with "TECHMART" LTD.
(2) With the acceptance of these General Terms and Conditions, the users give their express prior consent to the users that the Primary contact email address indicated by them will be used for communication and exchange of electronic statements with "TECHMART" LTD, including in the process of concluding and executing contracts for the delivery of goods ordered by the user through the ELECTRONIC STORE.
(3) The User has the right to change his Primary contact email address. Upon receipt of a request to change the Main contact email address, "TECHMART" LTD sends a request for confirmation of the change. The request for confirmation is sent by "TECHMART" LTD to the new Primary contact email address specified by the User. The change of the Primary contact e-mail address is carried out after confirmation by the User, expressed through a reference contained in the request for confirmation sent by "TECHMART" LTD to the new Primary contact e-mail address specified by the User.
(4) "TECHMART" LTD informs the User about the change by means of an e-mail sent to the Main contact e-mail address specified by the User before making the change.
(5) "TECHMART" LTD is not responsible to the User for an illegal change of the Main contact email address.
(6) "TECHMART" LTD may require the User to use the Primary contact email address in specific cases.
V. PROTECTION OF PERSONAL DATA
Art. 9. (1) "TECHMART" LTD takes technical and organizational measures to protect the User's personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons in connection with the processing of personal data and on the free movement of such data and for the repeal of Directive 95/46/EC (General Data Protection Regulation), the Personal Data Protection Act, as well as all applicable legal acts in the field of personal data protection .
(2) "TECHMART" LTD is the administrator of personal data, according to Art. 4, item 7 of Regulation (EU) 2016/679, established on the territory of the Cyprus and processes personal data lawfully and in good faith in connection with the purposes of its activity - wholesale and retail trade of goods and does not process them additionally in a manner, incompatible with these purposes. When carrying out certain activities by order and on behalf of its partners, "TECHMART" LTD can perform the role of a personal data processor within the meaning of Art. 4, item 8 of Regulation (EU) 2016/679, and these relations are regulated by an agreement under Art. 28, par. 3 of Regulation (EU) 2016/679.
(3) "TECHMART" LTD processes personal data in compliance with the basic principles of data protection and in the presence of at least one of the grounds for admissibility of the processing, according to Regulation (EU) 2016/679.
(4) "TECHMART" LTD refers to consent when processing personal data, when there is no other legal basis specified in Art. 6 of Regulation (EU) 2016/679. "TECHMART" LTD processes personal data for the stated purposes or on the condition that the natural person to whom the data refers has given his express consent.
(5) "TECHMART" LTD does not process personal data revealing racial or ethnic origin, political views, religious or philosophical beliefs or membership in trade union organizations, as well as genetic data, biometric data for the sole purpose of identifying a natural person, data about the state of health or data about the sex life or sexual orientation of the individual - User of the site.
(6) For reasons of security of the User's personal data, "TECHMART" LTD sends information containing such data only to the electronic address that was specified by the User at the time of registration.
Art. 10. (1) When "TECHMART" LTD has reasonable concerns regarding the identity of the User with whom it exchanges information containing personal data, "TECHMART" LTD may request the provision of additional information necessary to confirm the identity of the User, including in the exercise of rights within the meaning of Art. 15-22 of Regulation (EU) 2016/679.
(2) If for some reason the User has forgotten or lost their username and password, "TECHMART" LTD has the right to apply the announced "Procedure for lost or forgotten usernames and passwords"
(3) The personal data that the User provides, as well as the personal data that "TECHMART" LTD receives in the process of providing its commercial services , are processed and stored by "TECHMART" LTD in accordance with the General Regulation for the protection of personal data (Regulation (EU) 2016/679 of the European Parliament) and the Personal Data Protection Act.
(4) Detailed information on the purposes and legal basis for the processing of personal data; the categories of recipients of personal data; the period for which the personal data will be stored; the rights of data subjects in connection with the processing of their personal data by "TECHMART" LTD, as well as information on the way in which they can be exercised; contact details of the data protection officer and any other information that the General Regulation on the Protection of Personal Data requires to be provided to Users is contained in the Privacy Policy of "TECHMART" LTD, which is published on the ELECTRONIC STORE .
VI. COOKIE POLICY
Art. 11. In order to increase efficiency, ELECTRONIC STORE uses cookies. Processing and storage of data from cookies is carried out in accordance with the provisions of the General Regulation for the Protection of Personal Data and the Cookie Policy of "TECHMART" LTD, which is published on ELECTRONIC STORE.
VII. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS Art . 12. (1) The content, logos, any graphic images or inscriptions, commercial symbols, dynamic symbols, texts and/or multimedia content of the ELECTRONIC STORE are the exclusive property of "TECHMART" LTD. (2) "TECHMART" LTD has and retains all intellectual property rights related in any way to the ELECTRONIC STORE, regardless of whether they are its own or obtained through contractual licenses or in any other lawful manner. (3) Nothing in the conclusions between "TECHMART" LTD and the User of the remote contract will be considered as permission on the part of "TECHMART" LTD for the latter to copy, distribute, publish, provide to third parties, modify in any way to be in any way part of the content of the trademarks, logos, multimedia content of ELECTRONIC STORE or product or service descriptions, including by introducing any content external to ELECTRONIC STORE, removing the signs denoting the right of ownership of "TECHMART" LTD on the content. The user has no right to transfer, sell, distribute materials created by reproducing (copying), modifying or publishing the content, except with the express consent of "TECHMART" LTD. (4) The user may copy, transfer and/or use the content only for personal non-commercial purposes and only in cases where this does not contradict the provisions of this chapter of the general terms and conditions. (5) The user has the right to use the content for commercial purposes only and only if he has received the written consent "TECHMART" LTD for this and only for the part of the content, in the manner and to the extent of its use, as well as in the times limits for which this consent is expressly given. Any subsequent or different use of the content will be considered a violation of this contract between "TECHMART" LTD and the User and a violation of the intellectual property rights "TECHMART" LTD, which has the right to seek the responsibility of the User for this . (6) Mere sending to the User or referring to the content or parts of it by "TECHMART" LTD will not be considered as consent on the part "TECHMART" LTD to allow the User to use the content or parts of it for his own purposes, other than his personal needs, regardless of the means of communication used by "TECHMART" LTD. (7) Any use of the content for purposes other than those expressly permitted in these general conditions or in another express written consent given by "TECHMART" LTD is prohibited.
VI II . SPECIAL OBLIGATIONS OF "TECHMART" LTD. CONSUMER PROTECTION
Art. 13. The rules of this Section VIII of these General Terms and Conditions apply to Users for whom, according to the data specified for the conclusion of the sales contract or during the registration in the ELECTRONIC STORE, it can be concluded that they are users within the meaning of the Law for consumer protection, the Electronic Commerce Act and/or Directive 97/7/EC of the European Parliament and of the Council of 20 May 1997 on consumer protection in relation to distance contracts.
Art. 14. (1) The main characteristics of the goods offered by "TECHMART" LTD are defined in the profile of each product on the ELECTRONIC STORE website.
(2) All prices indicated in the ELECTRONIC STORE are in Euro and include VAT. The price of the goods, including all taxes, is determined by "TECHMART" LTD in the profile of each product on the ELECTRONIC STORE website.
(3) The value of the postal and transport costs, not included in the price of the goods, is determined by "TECHMART" LTD and is provided as information to the Users at one of the following moments before concluding the contract:
- In the profile of each of the goods on the website of "TECHMART" LTD of ELECTRONIC STORE;
- When choosing the goods for concluding the purchase and sale contract .
(4) "TECHMART" LTD can determine in the ELECTRONIC STORE recommended prices from a supplier. Recommended price from a supplier is a recommended retail price of goods, which is provided by a manufacturer and/or a distributor to "TECHMART" LTD, and the selling price is formed independently by "TECHMART" LTD. The sole purpose of this information is to assist the User in his decision to purchase the goods. The User understands that the visualization of this information is for the purpose of informing the User of the specific recommended prices from a supplier and the sale prices and that his decision to purchase the goods at the sale price is not dictated by deception.
(5) "TECHMART" LTD may announce price reductions in which to set a reduced price. The reduced price represents a reference price, respectively the lowest price announced by "TECHMART" LTD for the last thirty days before the date of application of the reduced price of the goods.
(6) The selling prices of the goods represent the value of the goods announced by "TECHMART" LTD in ELECTRONIC STORE. "TECHMART" LTD may indicate clearly, in a clear way, the value of the amount in the difference between the selling price and the recommended price from a supplier and/or the value in percentages between the selling price and the reduced price
(7) The method of payment, delivery and execution of the contract is defined in the present general conditions, as well as the information provided to the User on the website of "TECHMART" LTD.
(8) In the case of online payments or bank payments"TECHMART" LTD bears no responsibility for any costs in connection with fees, commissions or other additional payments made by the User or his bank on the occasion of the transaction itself, as well as in cases of currency exchange, applied by the bank that issued the User's card in cases where the currency is different from EUR. The costs associated with such payments are for the account of the User. Therefore, "TECHMART" LTD recommends that Users check with their bank for possible additional fees that could be charged to them for online payments or such through a bank.
(9) When the User chooses a payment method for an order placed: "payment upon delivery" (implemented and designated respectively as "cash on delivery", "postal money order" or any other type of payment method permitted by law upon delivery of an order contract concluded online) accepted by "TECHMART" LTD, the User pays the value of the ordered goods to the courier upon receipt of the shipment.
(10) "TECHMART" LTD provides the Users with the possibility of deferred payment of the goods, in the case of their approval by a financing company that has a contract with "TECHMART" LTD.
(11) Users have the opportunity to choose the method of payment for the purchased goods when generating the order by specifying one of the above.
(12) All images placed on the ELECTRONIC STORE are only intended to create some idea of the type of Product/Service offered, and not to represent it accurately. Accordingly, it is possible that some of the images of the goods or services in the ELECTRONIC STORE (static/dynamic images/multimedia presentations/etc.) may not correspond to the appearance of the respective goods or may create a wrong impression of the service offered. "TECHMART" LTD will not be held responsible for such discrepancies.
(13) The information provided to the Users under this article is current at the time of its visualization on the ELECTRONIC STORE of "TECHMART" LTD before the conclusion of the purchase and sale contract.
(6) "TECHMART" LTD necessarily indicates the conditions for delivery of individual goods on the ELECTRONIC STORE website.
Art. 15. (1) The user agrees that "TECHMART" LTD has the right to accept advance payment for the contracts concluded with the user for the purchase and sale of goods and their delivery.
(2) The user chooses independently whether to pay "TECHMART" LTD the price of delivery of the goods before or at the time of their delivery.
IX. WAIVER OF PURCHASED GOODS
(2) When ordering a product that is not available in an ELECTRONIC STORE at the time of the order, the User has the right to withdraw from the contract at a distance or from the contract outside the commercial premises, without giving a reason, without owing compensation or penalty, 14 (fourteen) days, counted from the date on which the User or a third party other than the carrier and indicated by him came into possession of the goods or the date on which
the User or a third party other than the carrier and indicated by him entered in possession of the last goods, in the case of a contract under which many goods are ordered in one order, according to the provisions of the Consumer Protection Act.
(4) In the event that the User withdraws from the contract, "TECHMART" LTD will refund all payments received, including delivery costs, only if the User has not received the item he ordered (with the exception of the return costs, which are at the expense of the User or additional costs related to a method of delivery chosen by the User, other than the cheapest standard method of delivery offered by "TECHMART" LTD, without undue delay and in any case no later than 14 (fourteen) days from the date on which the User informs "TECHMART" LTD of his decision to withdraw from the contract.
(5) By accepting the present general conditions, the User expressly agrees that the refund of the amount paid by him shall be made to a bank account provided by him.
(6) "TECHMART" LTD has the right to postpone the refund of payments until the goods are received back or until evidence is presented that the goods have been sent back, depending on which of the two events occurred earlier.
(7) The user should send "TECHMART" LTD or return the goods without undue delay and in all cases no later than 14 (fourteen) days after the day on which he informed "TECHMART" LTD of you repudiated the contract.
(8) The deadline is considered to have been met if the User sends back the goods to "TECHMART" LTD before the expiration of the 14-day deadline.
(9) The direct costs of returning the goods are for the account of the User.
(10) The goods should be returned in their original packaging in its entirety, complete with accompanying documentation and undamaged, in the form in which it was received. "TECHMART" LTD reserves the right, in case the returned goods have damaged packaging, traces of use, scratches, bumps, damaged by electric shock, with missing accessories, warranty card, to consider whether to accept the returned goods.
(11) The user is responsible for reducing the value of the goods as a result of their testing, other than what is necessary to establish their nature, characteristics and good functioning. Testing in a manner other than necessary is considered any testing of the goods that is different from what is required in the practice of usual and reasonable testing in the commercial establishment.
(12) When "TECHMART" LTD has not fulfilled its obligations to provide information, defined in Art. 54 of the Consumer Protection Act, the User has the right to withdraw from the concluded contract within three months from the date of receipt of the goods. When the information under this paragraph is provided to the User within the opt-out period, it begins to run from the date of its provision.
(13) The user undertakes to store the goods received from "TECHMART" LTD, their quality and safety during the period in which the right of refusal can be exercised.
(14) Refusal of certain types of purchased goods may be exercised, according to the provisions of the Consumer Protection Act and under the following conditions:
14.1. Printers and/or multifunctional devices and their consumables should be returned by the User: in a complete set and intact packaging of the consumables /toner, etc./. In the event that the integrity of the packaging of the relevant consumable is violated, the User may exercise his right to refuse the purchased printer and/or multifunction devices and the consumables for them, and should pay at his own expense the value of the consumable with damaged packaging.
14.2. Laptops , notebooks, desktop computers, monitors, consoles - should be returned without entering/activating passwords, profiles and others preventing the restoration of settings in their original form. Merchandise is non-returnable if an OEM license has been activated or if the original operating systems and/or other programs it came with have been uninstalled.
14.3. Mobile phones, tablets and accessories - should be returned without
entered/activated passwords, profiles and others preventing the restoration of the settings in their original form. The goods cannot be returned if an OEM license has been activated or if the original operating systems and/or other programs with which the goods were delivered have been uninstalled or if the protective film (for tablets and phones) has been used and/or removed.
14.4. Large white goods - refrigerators, dishwashers, cookers, microwave ovens, hoods, washing machines and the like in the category of large white goods, should be returned, packed properly for transport (in the same way as delivered).
14.5. Air conditioners and air conditioning systems can only be returned if no installation has been carried out. Once installed, air conditioners and air conditioning systems cannot be returned.
14.6. Cleaning devices such as vacuum cleaners, robots and others , after use, can only be returned in cases where a test period is mentioned. At the discretion of "TECHMART" LTD., an amount may be deducted from the value of the item in order to replace the used consumables and return the device, but the amount that "TECHMART" LTD. will refund in this case will be reduced by the cost of consumables.
(15) The provisions of Art. 50 – 56 of the Consumer Protection Act on the User's right of withdrawal from the contract at a distance or from the contract outside the commercial premises do not apply to contracts:
15.1. For the provision of services, where the service is fully provided, when the contract provides for an obligation for the User to pay, and the performance has begun with the explicit prior consent and confirmation of the User that he knows that he will lose his right of withdrawal after the contract is performed entirely by "TECHMART" LTD;
15.2. For the supply of goods or services, the price of which depends on the fluctuations of the financial market, which cannot be controlled by "TECHMART" LTD and which may occur during the period for exercising the right of refusal;
15.3. For the delivery of goods made to the order of the User or according to his individual requirements;
15.4. For the delivery of goods which, due to their nature, may deteriorate in quality or have a short shelf life;
15.5. For the delivery of sealed goods which have been unsealed after their delivery and cannot be returned for hygiene or health protection reasons;
15.6. For the delivery of goods which, after being delivered and due to their nature, have been mixed with other goods from which they cannot be separated;
15.7. For the delivery of alcoholic beverages, the price of which is agreed at the conclusion of the sales contract, where the delivery can be made within a period of no earlier than 30 (thirty) days, counted from the conclusion of the contract, and whose actual value depends on fluctuations on the market, which cannot be controlled by "TECHMART" LTD;
15.8. Where the User has expressly requested "TECHMART" LTD to visit him at his home in order to carry out urgent repair or maintenance activities; when, during such a visit, "TECHMART" LTD provides other services in addition to those requested by the User, or delivers goods other than the spare parts necessary to carry out the repair or maintenance, the right of refusal applies to these additional services or goods;
15.9. For the delivery of sealed sound or video recordings or sealed computer software that have been unsealed after delivery;
15.10. For the delivery of newspapers, periodicals or magazines with the exception of subscription contracts for the delivery of such publications;
15.11. Concluded during a public auction;
15.12. For the provision of accommodation services that are not intended for living, transport of goods, car rental, catering services or the provision of services related to entertainment activities, if the contract stipulates a specific date or term of performance;
15.14. For the provision of services that oblige the User to pay, when the User has expressly requested "TECHMART" LTD to visit him at his home to carry out repair activities, after the service has been fully provided and the performance has begun with the express prior consent of the User.
(16) When the User exercises his right of withdrawal from the contract at a distance or from the contract off-premises, any additional contract is terminated automatically without the User being liable for any costs, compensations and/or penalties, except for the costs provided for in the Consumer Protection Act. The above does not apply in relation to Art. 28 of the Consumer Credit Act .
(17) The user may return the purchased goods to the last office chosen by the courier company from which the order was received, under the following conditions:

2. Fill out and send the product return form electronically or on paper.
3. Place the completed form together with the returned product(s) in appropriate packaging so as not to damage its integrity.
4. Take the package to the last office of the courier company from which you received the order. For the recipient's address, the User should select the address that is written on the bill of lading with which the product(s) was delivered.
(18) The user can return the purchased goods from home under the following conditions:
1. By contacting "TECHMART" LTD on phone +357 25 333 150 or by email: d.dimitrov@techmart.com.cy
2. Complete and send the return form to product electronically or on paper.
3. Place the completed form together with the returned product(s) in appropriate packaging so as not to damage its integrity.
4. By contacting the courier company from which he received the package and finding out about a time to pick up the package. For the recipient's address, the User should select the address that is written on the bill of lading with which the product(s) was delivered.
(19) The user can return the received goods to a convenient location of the Techmart chain under the following conditions:
1. By bringing the device to the site, together with all accompanying documents.
2. Complete and submit the product return form electronically or at the site.

Art. 17. (2) In the event that the User and "TECHMART" LTD have not agreed on a different delivery time, the delivery time of the goods is 10 (ten) working days, calculated from the date following the sending of the User's order to "TECHMART" LTD through the website of "TECHMART" LTD ELECTRONIC STORE.
(3) In the event that "TECHMART" LTD cannot fulfill the contract due to the fact that it does not have the ordered goods, it is obliged to notify the User about this and to refund the amounts paid by him within 14 (thirty) working days days from the date on which "TECHMART" LTD was supposed to fulfill its obligation under the contract.
(4) In the cases described above, "TECHMART" LTD has the right to supply the User with goods of the same quality and price. "TECHMART" LTD notifies the User electronically about the change in the performance of the contract.
XI. TECHNICAL STEPS FOR CONCLUSION OF A PURCHASE-SALE CONTRACT
Art. 18. (1) Users primarily use the interface on the page of "TECHMART" LTD to enter into contracts for the purchase and sale of the goods offered by ""TECHMART" LTD in the ELECTRONIC STORE.
(2) The contract is concluded in English.
(3) In relation to all contracts for the purchase and sale of goods between "TECHMART" LTD and the User, the present general terms and conditions, available at the following Internet address www.techmart.com.cy, apply.
(4) Party to the contract with "TECHMART" LTD is the User according to the data provided during registration and contained in the User's personal profile or provided when generating an order as an unregistered user. For the avoidance of doubt, these are the data with which an account was created with "TECHMART" LTD or the data provided by the User, as an unregistered user, when generating the order.
(5) "TECHMART" LTD includes in the interface of its Internet page technical means for identifying and correcting errors when entering information before the statement for concluding the contract is made.
(6) The contract for the purchase and sale of goods is considered concluded from the moment of its application by the User through the interface of the ELECTRONIC STORE of "TECHMART" LTD.
(7) For the conclusion of the contract for the purchase and sale of goods "TECHMART" LTD expressly notifies the User at the Primary contact email address indicated by him.
(8) The statement of conclusion of the contract and the confirmation of its receipt are considered received when their addressees have the opportunity to access them.
(9) "TECHMART" LTD delivers the goods to the address specified by the Users and is not responsible in case the data specified by the Users is incorrect or misleading.
Art. 19. Users conclude the purchase and sale contract with "TECHMART" LTD, according to the following procedure:
(1) Registration in the ELECTRONIC STORE and provision of the necessary data, if the User has not yet registered in the ELECTRONIC STORE or as an unregistered user ;
(2) Entering the ELECTRONIC STORE ordering system by identifying with a registered user's name and password;
(3) Selecting one or more of the goods offered on the ELECTRONIC STORE and adding them to a list of goods for purchase;
(4) Provision of delivery data;
(5) Choice of method and moment of payment of the price.
(6) Order confirmation.
X II. DELIVERY TERMS FOR ONLINE SHOPPING
DELIVERY OF GOODS ORDERED ONLINE
Art. 20. The goods ordered online are delivered by a courier company, only and only on the territory of the Cyprus.
Courier company office, if they have one in the relevant town. This option does not apply to goods from the categories Large white goods, Air conditioners and heating, Built-in appliances.
XIII . OTHER CONDITIONS
Art. 21. The user must inspect the goods at the time of delivery and handover by "TECHMART" LTD /courier and if it does not meet the requirements, immediately notify "TECHMART" LTD.
Art. 22. All orders are shipped with shipment insurance. When the courier delivers the order, the cash on delivery amount is paid. In the presence of the courier, the package is carefully inspected for visible injuries, tears, crushes, etc. The package is opened and the product(s) is inspected for breakage, injury or other damage. If damage is found to the product(s), a transport damage document is drawn up with the courier and the shipment is returned. After receiving the information from the courier company, "TECHMART" LTD will promptly send a new product/products.
Art. 23. If the conditions for inspecting the goods before the courier are not met by the User, "TECHMART" LTD is not responsible for claims made related to the integrity of the product.
Art. 24. Each order received through a courier company is accompanied by accompanying documentation - receipt or invoice, warranty card, which must be checked and kept by the User at the time of receipt of the order, in case of a possible complaint by the User or in the future spare parts reference.
*Otherwise, "TECHMART" LTD is not responsible for lost documents and the consequences resulting from their loss.
XI V. TERMINATION
Art. 25. The User's electronically concluded individual contract with "TECHMART" LTD is terminated in the following cases:
- upon termination and declaration of liquidation or declaration of bankruptcy of one of the parties to the contract;
- by mutual agreement of the parties in writing;
- unilaterally, with notice from each of the parties in case of non-fulfilment of the obligations of the other party;
- in case of objective inability of one of the parties to the contract to fulfill its obligations;
- when the equipment is seized or sealed by state authorities;
- in case of deletion of the User's registration on the ELECTRONIC STORE website. In this case, the concluded but unexecuted purchase and sale contracts remain valid and enforceable;
- in case of exercising the right of refusal according to Art. 55, para. 1 of the Consumer Protection Act.
X V. WARRANTY SERVICE
Art. 26. "TECHMART" LTD is responsible for any lack of conformity of the consumer goods with the sales contract, which exists when the goods are delivered and occurs up to two years after their delivery, according to the provisions of Art. 31 of the Law on the provision of digital content and digital services and on the sale of goods - "ZPCSCUPS" ("Legal Guarantee"). "TECHMART" LTD is responsible according to the Legal Guarantee to persons having the status of consumer.
Art. 27. Commercial guarantee is any obligation undertaken by "TECHMART" LTD or the manufacturer (guarantor) to the User, in addition to his obligation by law to ensure compliance of the goods with the sales contract, in order to refund the amount paid or replace or repair the goods or provide another type of service related to the goods when they do not meet the specifications or possibly other requirements unrelated to the conformity of the goods with the contract of sale specified in the application for the provision of a commercial guarantee or in the relevant advertisement, made at the time of conclusion or before the conclusion of the contract. The commercial guarantee is an independent obligation assumed by the manufacturer and/or the trader and does not affect the rights that Users have under the provisions of the Act on the provision of digital content and digital services and on the sale of goods.
Art. 28. The warranty service of the goods offered by "TECHMART" LTD is carried out for the period and according to the conditions specified in the warranty card of the respective goods. With each delivery of goods subject to warranty service, "TECHMART" LTD issues and provides the User with an appropriate warranty card with the product data and warranty terms, as well as all conditions of the provided commercial warranty, if any.
Art. 29. The guarantee does not apply:
a) if the guarantee card is lost;
b) when repair is attempted by an unauthorized service;
c) in case of damage caused by incorrect operation;
d) in case of violation of the physical integrity of the product;
e) in case of chemical, electrical or other impact other than the normal operation of the product;
Art. 30. Warranty service is carried out only by the service centers specified in the warranty card, with full documentation and product packaging.
Art. 31. The commercial warranty provided for the product does not cover components of the product with a limited shelf life (batteries, consumables, etc.).
Art. 32. The products and services specified in the ELECTRONIC STORE are limited only to the general conditions and information specified in the ELECTRONIC STORE, without any guarantees beyond those specified, including merchantability and purpose. The obligations of "TECHMART" LTD regarding the products and services offered in the ELECTRONIC STORE are regulated by the relevant agreements with the importers and/or distributors of the presented products.
XVI. AMENDMENT AND ACCESS TO THE GENERAL CONDITIONS
Art. 34. (1) These general terms and conditions may be amended by "TECHMART" LTD, for which the latter will, if possible, notify in an appropriate manner all registered ELECTRONIC STORE Users. Acceptance of the general terms and conditions is a mandatory element when generating any order in the ELECTRONIC STORE.
(2) "TECHMART" LTD and the User agree that any addition and amendment to these general terms and conditions will have effect on the User after explicit notification by "TECHMART" LTD or upon learning of them and if the User does not state in the provided his 14-day period from notification or after learning that he rejects them.
(3) The User agrees that all statements of "TECHMART" LTD, in connection with the amendment of these general conditions, will be sent to the e-mail address specified by the User during registration. The user agrees that e-mails sent pursuant to this article do not need to be signed with an electronic signature in order to be effective against him.
Art. 35. "TECHMART" LTD publishes these general conditions at techmart.com.cy, together with all additions and amendments to them.
